Current Legislative Issues:

Should a fertilized egg have legal rights? That question is being posed by a controversial ballot initiative in Colorado which voters will decide the fate of in November.. Backers of the initiative, Amendment 48, say that a fertilized egg should be granted full rights as a person in Colorado’s legal system. They want to amend the Colorado constitution to define “person” to include any human being from the moment of fertilization. This would give fertilized eggs: inalienable rights, equality of justice, and due process of law. Abortion would therefore be illegal.

Opponents say Amendment 48 is an attempt to deny Colorado women and their families access to the full range of reproductive services It would have to be interpreted in court whether forms of birth control that keep a fertilized egg from being implanted would be banned or if a life-threatening ectopic pregnancy could be terminated. The proposed initiative leaves no room for exceptions to consider the situations above; nor does it include explanatory language that would direct lawmakers, when crafting implementing legislation in good faith, to carve out reproductive-health exceptions or to create "situations of lesser entitlement" for the above circumstances.
